Description
Per Curiam. Appeal by the claimant from a judgment of the Court of Claims dismissing his action. The State loaned to the Village of Catskill a sand loading machine for which no charge was made. At the time of the accident the machine was being operated by the claimant, a village employee. The claimant alleged that the accident occurred as the result of a defect in the machine, but the court found that the claimant failed to prove any defect in the machine and tht the State was not guilty of negligence. Considering the record as a whole, it appears that there was insufficient evidence to sustain claimant's burden of proof. Under the circumstances, it is not necessary to consider any other alleged errors. Judgment affirmed, without costs. Gibson, P.J., Herlihy, Aulisi, Staley, Jr., and Gabrielli, JJ., concur in memorandum Per Curiam. [ 48 Misc. 2d 43. ]
